Warranty and Technical Claims Policy

This Warranty & Technical Claims Policy governs warranty claims, technical defect claims and product performance claims submitted to AWD.TECH.
Nothing in this Policy limits or excludes rights that cannot be limited or excluded under applicable law.
For the purposes of this Policy, "AWD.TECH", "AWD", "we", "us" and "our" refer to MB Optima Solutio.
1. GENERAL PRINCIPLES
AWD.TECH is committed to resolving legitimate product-related issues in a fair, objective and technically substantiated manner.
The existence of a malfunction, wear condition, performance issue or product failure does not by itself establish that the supplied Product was defective.
A warranty or technical claim must be supported by sufficient information to enable AWD.TECH to determine whether the reported issue originates from the supplied Product.
AWD.TECH reserves the right to request documentation, diagnostic records, photographs, videos, inspection reports, expert opinions and other information reasonably necessary to assess a claim.
2. PRODUCT CATEGORIES
For claim assessment purposes, AWD.TECH distinguishes between:
Complete Units
Products supplied as complete assembled units, including but not limited to:
- remanufactured transfer cases;
- remanufactured differentials;
- remanufactured coupling units;
- complete rebuilt assemblies.
Components, Parts and Repair Kits
Products supplied as individual components or repair parts, including but not limited to:
- chains;
- bearings;
- gears;
- shafts;
- forks;
- housings;
- friction components;
- repair kits;
- overhaul kits;
- rebuild kits;
- seals;
- gaskets;
- electronic components.
Different claim assessment standards apply to different product categories.
3. COMPLETE UNIT WARRANTY CLAIMS
Where a warranty applies to a Complete Unit, the applicable warranty period shall be the period specified in:
- the product listing;
- the invoice;
- accompanying documentation; or
- written communication issued by AWD.TECH.
Warranty coverage does not extend to failures caused wholly or partly by:
- incorrect installation;
- improper commissioning;
- failure to perform required adaptation procedures;
- failure to perform required programming procedures;
- use of incorrect lubricants or fluids;
- contamination;
- cooling system defects;
- electrical faults;
- drivetrain defects;
- vehicle modifications;
- abuse;
- misuse;
- accidents;
- neglect;
- normal wear.
AWD.TECH may require diagnostic evidence demonstrating that installation and commissioning procedures were correctly completed.
4. COMPONENTS, PARTS AND REPAIR KITS
Components, replacement parts and repair kits are intended to be incorporated into assemblies and systems whose condition, maintenance history, assembly quality and operating condition are outside the control of AWD.TECH.
Accordingly, AWD.TECH does not guarantee the service life, durability, operating lifespan or wear characteristics of individual components, repair parts or repair kits.
The existence of wear, damage, breakage or failure does not by itself establish that a component was defective when supplied.
Claims relating to components, replacement parts or repair kits must be supported by objective technical evidence demonstrating that the reported issue originated from a defect in the supplied Product and not from:
- installation error;
- assembly error;
- adjustment error;
- contamination;
- lubrication failure;
- associated component failure;
- pre-existing assembly defects;
- vehicle-related conditions;
- operating conditions;
- misuse;
- normal wear.
5. CLAIM DOCUMENTATION
AWD.TECH may require any information reasonably necessary to assess a claim, including:
- order number;
- VIN;
- mileage;
- photographs;
- videos;
- fault code reports;
- diagnostic reports;
- installation records;
- workshop invoices;
- work orders;
- commissioning records;
- adaptation records;
- programming records.
Failure to provide reasonably requested documentation may prevent AWD.TECH from determining the origin of the reported issue.
6. PROFESSIONAL INSTALLATION
AWD.TECH strongly recommends installation by suitably qualified automotive professionals.
Where a claim relates to a component, repair part or repair kit, AWD.TECH may require documentation demonstrating that installation was performed by a suitably qualified workshop.
Such documentation may include:
- work orders;
- invoices;
- installation reports;
- workshop records.
Submission of installation documentation does not by itself establish the validity of a claim.
7. TECHNICAL EVIDENCE
Claims relating to individual components, replacement parts or repair kits must be supported by objective technical evidence demonstrating that the reported issue originated from a defect in the supplied Product.
Such evidence may include:
- independent engineering reports;
- laboratory analysis;
- dimensional measurements;
- metallurgical examination;
- technical inspection reports;
- other technically reliable evidence.
The cost of obtaining such evidence shall be borne by the claimant.
AWD.TECH is under no obligation to commission, fund or obtain expert reports on behalf of the claimant.
In the absence of sufficient technical evidence, AWD.TECH may be unable to determine that the reported issue originated from the supplied Product.
8. SOFTWARE-DEPENDENT PRODUCTS
Certain Products require:
- coding;
- programming;
- adaptation;
- calibration;
- commissioning.
Claims relating to such Products may require:
- pre-installation diagnostic reports;
- post-installation diagnostic reports;
- programming records;
- adaptation records;
- fault code reports.
AWD.TECH may be unable to determine the origin of a reported issue where such documentation is unavailable.
9. MODIFIED VEHICLES
Products supplied by AWD.TECH are intended for vehicles operating within manufacturer specifications.
AWD.TECH may consider whether modifications contributed to a reported issue, including:
- engine tuning;
- power increases;
- torque increases;
- transmission software modifications;
- drivetrain modifications.
The existence of vehicle modifications does not automatically invalidate a claim but may be considered when determining causation.
10. INSPECTION RIGHTS
AWD.TECH reserves the right to require return of the Product, component, assembly or any related part for inspection, testing, disassembly or technical evaluation where reasonably necessary to assess a claim.
Customers shall preserve the Product and associated evidence pending completion of claim assessment.
Products should not be altered, dismantled, modified or disposed of without prior approval from AWD.TECH where a claim is being investigated.
11. REMEDIES
Where AWD.TECH determines that a claim is valid, AWD.TECH may, at its discretion and subject to applicable law:
- repair the Product;
- replace the Product;
- provide a refund;
- provide a partial refund;
- provide another appropriate remedy.
12. COSTS NOT COVERED
Unless otherwise required by applicable law, AWD.TECH shall not be responsible for:
- removal costs;
- installation costs;
- labour charges;
- diagnostic charges;
- programming costs;
- adaptation costs;
- calibration costs;
- towing expenses;
- vehicle rental costs;
- loss of use;
- loss of profits;
- business interruption;
- indirect losses;
- consequential losses.
Where a warranty claim relating to a Complete Unit is accepted, AWD.TECH may reimburse reasonable return shipping costs associated with the approved claim.
13. BUSINESS CUSTOMERS
Where Products are supplied by third-party manufacturers, AWD.TECH may assist Business Customers in presenting claims to the relevant manufacturer, supplier or remanufacturer.
AWD.TECH does not guarantee acceptance of any claim by a third party.
14. STATUTORY RIGHTS
Nothing in this Policy limits, excludes or affects rights that cannot legally be waived under applicable law.
Consumers retain all mandatory rights available under applicable consumer protection legislation.
